BOSTON (AP) — Massachusetts Sen. John Kerry is asking Congress to approve $8.5 million in payments to the families of two men who allegedly died at the hands of former Boston mob boss James “Whitey” Bulger.

A federal judge in 2009 awarded the money to the families of Michael Donahue and Brian Halloran in a wrongful death lawsuit against the FBI. But an appeals court threw out the award this month, saying the families waited too long to file their claims.

The suit claimed the men were gunned down in 1982 after the FBI leaked information about Halloran to Bulger.

Kerry said Tuesday he was filing legislation requiring the U.S. Treasury to pay the $8.5 million. He said Congress had an obligation to put things right.

U.S. Rep William Keating has filed a similar measure in the House
