At a two-day pre-trial hearing last week on a major mob murder case that has been snake-bit by government missteps, White Plains Federal Judge Cathy Seibel blasted federal prosecutors for a series of screw-ups and misrepresentations.
Mr. Capeci writes, Never in her 33 years as an officer of the court, the judge said, had she seen a case with as many government miscues, and on so many different issues, as she has encountered in the case pending against five Luchese gangsters charged with the 2013 gangland-style slaying of former Purple Gang leader Michael Meldish.
“I have never seen a case that even comes close to warranting an inspection of the grand jury minutes until now, and I have never seen such a string of problems in one case,” Seibel said on the first day of the hearing. That day ended with a call for legal briefs on whether errors could be “reckless” or had to be “intentional” to allow her to invade the secret grand jury process and throw out an indictment.
