A month after a federal appeals court ordered the Brooklyn U.S. Attorney’s office to cite all the evidence it used to convict Gambino consigliere Frank (Frankie Loc) Locascio of being part of a murder plot with Mafia boss John Gotti to kill mobster Louis DiBono, prosecutors have come up mostly empty.

But they did come up with a novel analysis of the Dapper Don as a chief executive who welcomed being contradicted by his underlings.

In a ten-page filing made in response to the surprise ruling last month in Locascio’s favor by the Second Circuit Court of Appeals, the feds fell back on the same FBI tape presented at the trial in which Gotti is heard saying DiBono is going to be killed. In that notorious December 12, 1989 taped talk, Gotti is heard to say of DiBono, “He’s gonna die because he refused to come in.”
