MYFOXNY.COM – FOX News Senior Judicial Analyst Judge Andrew Napolitano says “four is enough” when it comes to trying people in a court of law.

A fourth mistrial was declared in John ‘Junior’ Gotti’s racketeering, consiracy and murder trial on Tuesday.

Good Day NY spoke with Judge Napolitano on Wednesday.

“There is an unwritten rule to stop at three” when trying an individual, says Judge Napolitano. “It’s the first time in the post- World War II era (Gotti’s four trials) .. it’s undeard of.”

“He should not be tried again.”

The lead prosecutor shook Gotti’s hand as if to wish him well on Tuesday. Judge Napolitano says that could be an indication “it’s over.”
