BOSTON — The highest court in Massachusetts has ordered a judge to consider new DNA evidence in the case of two men convicted of murdering two alleged mob associates in the 1980s.
Boston, Massachusetts. Mob associates Frank DiBenedetto and Louis Costa were convicted in the North End murders of Frank Chiuchiolo and Joseph Bottari in Boston in 1986. In a 2001 ruling, the 1st U.S. Circuit Court of Appeals said all four men “reportedly had connections to the Patriarca organized crime Family of La Cosa Nostra.
But DiBenedetto’s lawyer said he was never affiliated with the mob.
Both DiBenedetto and Costa argued that newly discovered evidence shows that none of the DNA found on DiBenedetto’s sneakers came from either of the victims.
